Terms of Service

These Terms of Service ("Terms") govern your use of WatchPassport, including the WatchPassport website, digital watch passports, lookup service and related features (collectively, the "Service").

By creating an account, registering or taking over a watch passport, purchasing a paid service, or otherwise using features that require acceptance of these Terms, you agree to these Terms.

If you do not agree to these Terms, you should not use those features of the Service.

1. About WatchPassport

WatchPassport is a digital documentation and history platform for watches.

The Service is designed to help owners maintain a digital record associated with a watch, including information about its identity, ownership history, condition, servicing, documentation and other events.

A WatchPassport can remain associated with a watch as it changes owners, allowing relevant parts of its documented history to continue with it.

WatchPassport also provides tools intended to improve transparency and trust around watches and the second-hand watch market, including watch lookup, ownership transfers, stolen-watch reporting and mechanisms for handling conflicting registration or ownership claims.

WatchPassport is not a marketplace, watch dealer, insurer, escrow service, law enforcement authority or professional watch authentication service unless expressly stated otherwise for a particular feature.

2. Service development

WatchPassport is under active development.

Features and functionality may change as the Service develops. Features may be added, modified, restricted, temporarily unavailable or removed, and some processes may occasionally require manual review or intervention.

We aim to operate and improve the Service responsibly, but users should keep independent copies of important documents, photographs, receipts, warranty information, service records and other information they would not want to lose.

3. Accounts and eligibility

You must provide accurate information when creating and maintaining your account.

You are responsible for keeping your account credentials secure and for activity carried out through your account, except where applicable law provides otherwise.

You must notify us if you reasonably believe your account has been accessed without your permission.

You may not impersonate another person, deliberately provide false account information or use another person's account without permission.

If you are under 18, you may only enter into paid transactions through WatchPassport where you are legally permitted to do so or have any consent required by law.

4. Registering watches

You may only register or claim a watch where you have a legitimate basis for doing so.

When registering, claiming, transferring or updating a watch, you must provide information that you reasonably believe to be accurate. You must not deliberately provide false information or omit information in a way intended to mislead WatchPassport or another user.

We may require photographs, identifying information, verification material or other evidence before creating, transferring, reactivating or otherwise changing control of a passport.

You must not knowingly use WatchPassport to:

  • register counterfeit watches;
  • claim watches that you do not legitimately possess, own, or control;
  • create fabricated or deliberately misleading watch identities;
  • create false ownership, service, condition or historical records;
  • submit falsified documents, photographs or other evidence; or
  • create duplicate records intended to circumvent an existing passport, restriction or dispute.

We may reject, restrict, suspend or review registrations where we reasonably believe this is necessary to protect users or the integrity of the Service.

5. What verification means

WatchPassport may use verification measures intended to make false or fraudulent registrations more difficult and to establish useful evidence connecting a user with a particular watch.

These measures are intended to provide useful trust signals. They are not guarantees.

Unless expressly stated otherwise, WatchPassport does not independently authenticate every watch, component, document, photograph or statement submitted through the Service.

A WatchPassport therefore does not, by itself:

  • guarantee that a watch is authentic;
  • guarantee that every component is original or authentic;
  • prove legal ownership or title;
  • guarantee that uploaded documents are genuine;
  • guarantee that user-submitted information is correct;
  • guarantee the mechanical condition of a watch; or
  • guarantee that the recorded history is complete.

A WatchPassport is not a certificate of authenticity, certificate of title, warranty, insurance policy or professional appraisal.

Users should carry out appropriate independent due diligence before buying, selling, accepting, insuring or otherwise dealing with a watch.

6. Passport records and history

A core purpose of WatchPassport is to create a continuing record associated with a watch rather than only with one owner.

Certain information may therefore form part of the transferable passport history and remain associated with the watch after ownership changes.

This may include watch identity information, photographs, ownership periods, service or repair history, changes to the watch, status changes and other watch-related records.

Some historical information may be restricted from deletion or may retain an audit history where reasonably necessary to preserve the integrity and usefulness of the Service.

Where information is corrected or changed, WatchPassport may preserve a record showing that the change occurred.

The presence of information in a passport does not necessarily mean that WatchPassport independently verified that information unless the Service specifically states that it did.

7. Private information

Some information within WatchPassport is personal to an individual user and is not intended to transfer with a watch.

This may include private notes, personal photographs, acquisition information, prices paid or received and other information identified as private within the Service.

Private information from a previous owner will not become available to a later owner merely because control of the passport changes.

Our handling of personal information is explained further in our Privacy Policy.

8. Ownership and passport transfers

WatchPassport may allow control of a passport to be transferred when a watch changes hands.

A passport transfer records a change within WatchPassport. It does not itself transfer or establish legal ownership of the physical watch.

WatchPassport is not a party to the underlying purchase, sale, gift, inheritance, exchange or other transaction between users or third parties.

We do not determine the terms of those transactions and do not guarantee that either party will fulfil their obligations to the other.

Users remain responsible for the underlying transaction and for any laws, taxes, customs requirements, contractual obligations or other requirements that apply to it.

A passport transfer does not prevent a later review or dispute where credible information suggests that the watch identity, ownership history or transfer may have been incorrect or fraudulent.

9. Archived and inactive passports

A passport may become inactive or archived, including where a watch leaves the current owner's possession without a passport transfer being completed.

Archiving a passport does not normally erase its historical record.

A later person with a legitimate basis for possessing the watch may be able to request reactivation or control of the existing passport, subject to the requirements of the Service at that time.

Reactivation or control of a passport is a WatchPassport record and is not, by itself, a legal determination of ownership of the physical watch.

10. Stolen watches

WatchPassport may allow users to report watches as stolen.

A stolen flag is an important warning within the WatchPassport system, but it represents information recorded through the Service. It is not, by itself, a police report, court decision or independent legal determination that a theft occurred.

Similarly, the absence of a stolen flag does not guarantee that a watch has not been stolen.

A watch may be stolen without being registered with WatchPassport or without its theft having been reported to us.

You should therefore not rely on WatchPassport as your only stolen-watch check.

We may restrict transfers, registrations or other actions involving a watch reported as stolen while the matter remains unresolved.

Records showing that a watch was reported stolen or later recovered may remain part of its historical record.

Where appropriate, users should also report theft to the police, their insurer and any other relevant authority or registry.

11. Conflicting claims and disputes

Different users may occasionally make conflicting claims concerning the same watch or watch identity.

This can happen for legitimate or illegitimate reasons, including incomplete ownership transfers, incorrect information, copied identifying numbers, counterfeit watches or fraudulent registrations.

Where this happens, we may place a registration or passport under review and request further information or evidence.

To protect the integrity of WatchPassport, we may take reasonable administrative actions following such a review, including:

  • rejecting or accepting a claim;
  • correcting information;
  • transferring control of an existing passport;
  • suspending or invalidating a passport; or
  • restoring a passport to an appropriate status.

Any such decision determines how the watch is represented within WatchPassport only.

WatchPassport is not a court, law enforcement agency or other legal authority and does not make legally binding determinations about ownership of physical property, criminal liability, theft or authenticity.

Where users disagree about legal ownership or other legal rights, those issues must ultimately be resolved between the parties or through the appropriate authorities.

12. Public lookup

WatchPassport may make limited information about registered watches available through a public lookup service.

The purpose of lookup is to allow users to check information recorded in WatchPassport without exposing the identities or private information of watch owners.

A successful lookup only describes information held by WatchPassport.

A "not found" result does not mean that a watch is authentic, legitimate or free from theft.

Likewise, a result showing no current stolen flag only means that the matching WatchPassport record is not currently flagged as stolen within the Service.

Public lookup should be treated as one source of information when conducting due diligence, not as a definitive authentication or ownership verification service.

We may limit or restrict lookup activity to protect user privacy, platform security and the integrity of the Service.

13. User content

You retain ownership of original photographs, text and other content you upload to WatchPassport.

By uploading content, you give WatchPassport a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, resize, display and otherwise use that content to the extent reasonably necessary to operate the Service.

For content forming part of a transferable watch passport, this includes using and displaying the content as reasonably necessary to maintain the watch's continuing passport and historical record after your ownership ends.

For private content, our handling and retention practices are described in our Privacy Policy.

You must have the necessary rights to upload content you provide.

You must not upload content that unlawfully infringes another person's intellectual property, privacy or other rights.

14. Acceptable use

You must not misuse WatchPassport.

In particular, you must not:

  • knowingly submit fraudulent or materially misleading information;
  • deliberately create false watch histories or ownership records;
  • knowingly register or promote counterfeit watches as genuine;
  • make knowingly false stolen-watch reports;
  • make abusive or bad-faith claims against other users or passports;
  • falsify documents, photographs or other evidence;
  • attempt to access another user's private information without permission;
  • scrape, enumerate or systematically collect information from the Service without permission;
  • circumvent access controls, rate limits or other security measures;
  • interfere with or disrupt the operation of the Service;
  • introduce malicious software or code;
  • use the Service to commit fraud or other unlawful activity; or
  • assist another person in doing any of these things.

15. Fees and payments

Some parts of WatchPassport may require payment.

The applicable price, currency and any discount will be shown before you make a payment or commit to a paid transaction.

Prices and payment models may change over time. Changes to future pricing do not retroactively change transactions already completed.

Where a paid action involves processing, review, verification, handling of a claim or another service that we begin providing, the fee may remain payable even where the eventual outcome is not the outcome you hoped for.

Payments may be processed using third-party payment providers. Their terms and privacy practices may also apply to their processing of payment information.

16. Account deletion

You may request deletion or anonymisation of your account through the Service.

Because WatchPassport is designed to preserve the history of watches across different owners, deleting an account does not necessarily erase historical passport records associated with watches previously connected to that account.

When an account is deleted or anonymised, personal account information may be removed or anonymised while watch-related historical information may remain in an anonymised or owner-neutral form where reasonably necessary to preserve the integrity of the passport.

Private information that is not part of the transferable history may be deleted in accordance with our Privacy Policy.

Account deletion may also affect active passports, pending transfers or unresolved claims associated with the account.

Account deletion is generally irreversible.

17. Suspension and termination

We may restrict, suspend or terminate access to an account or passport where we reasonably believe this is necessary to:

  • investigate suspected fraud or abuse;
  • protect another user;
  • protect the integrity or security of WatchPassport;
  • respond to a stolen-watch report or conflicting claim;
  • address a serious or repeated breach of these Terms; or
  • comply with applicable law or a lawful request.

Serious or repeated violations may result in permanent account termination or passport invalidation.

Where reasonably appropriate, we may provide information about the reason for a significant restriction or suspension.

Termination of an account does not necessarily erase passport history that reasonably needs to remain associated with a watch.

18. Availability, changes and discontinuation

We aim to make WatchPassport reliable and useful, but we do not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, technical problems, security measures, third-party infrastructure or circumstances outside our reasonable control.

We also cannot guarantee that WatchPassport, or any particular feature of the Service, will remain available indefinitely.

We may modify, suspend or discontinue all or part of the Service where reasonably necessary, including for technical, security, legal, financial or operational reasons.

Where reasonably practicable, we will provide advance notice before permanently discontinuing the Service and give users a reasonable opportunity to access or export relevant information before closure.

You should keep independent copies of documentation and information that is important to you.

19. Third-party services

WatchPassport relies on third-party services and infrastructure to operate.

These may include hosting, storage, email, security, analytics and payment services.

Where a third party provides a service directly to you, its own terms and privacy practices may also apply.

We are not responsible for independent products or services provided directly by third parties, except to the extent applicable law makes us responsible for the delivery of our own Service.

20. Intellectual property

WatchPassport and its underlying software, design, branding, interface, documentation and original content are owned by or licensed to WatchPassport and are protected by applicable intellectual property laws.

These Terms give you a limited, non-exclusive right to use the Service in accordance with these Terms. They do not transfer ownership of WatchPassport intellectual property to you.

Watch brands, manufacturer names, logos and trademarks belong to their respective owners.

Unless expressly stated otherwise, WatchPassport is independent and is not affiliated with, endorsed by, sponsored by or authorised by any watch manufacturer, marketplace, dealer or other third party merely because its products, trademarks or names appear within the Service.

21. Responsibility and limitations

WatchPassport is intended to improve the information available about a watch and its history. It cannot eliminate the risks associated with buying, selling or owning watches.

You remain responsible for decisions you make based on information available through the Service.

WatchPassport is not responsible merely because:

  • another user supplied incorrect, incomplete or fraudulent information;
  • a watch later turns out to be counterfeit, modified or stolen;
  • a passport contains incomplete history;
  • a buyer, seller or other party fails to fulfil an agreement;
  • the market value of a watch changes;
  • a third party performs poor or incorrect work on a watch;
  • an external service or provider becomes unavailable; or
  • you relied on WatchPassport instead of carrying out reasonable independent checks.

WatchPassport is not responsible for the loss of or damage to a physical watch merely because information about that watch is stored through the Service.

22. Privacy

Our handling of personal data is described in the WatchPassport Privacy Policy.

The Privacy Policy should be read together with these Terms.

23. Changes to these Terms

We may update these Terms as WatchPassport develops or where reasonably necessary because of changes to the Service, law, security requirements or how WatchPassport operates.

The current version will be available through the Service and will show its effective date.

Where required, we will provide notice of material changes affecting existing users' rights or obligations.

Continued use of the Service after updated Terms take effect may constitute acceptance of those Terms where permitted by applicable law.

24. General terms

If part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

If we do not immediately enforce a provision of these Terms, this does not mean that we permanently waive the right to enforce it.

These Terms, together with the Privacy Policy and any additional terms clearly presented for a particular feature or transaction, form the agreement governing your use of WatchPassport.
